DOT SAP Evaluations

DOT and non-DOT SAP evaluations are mandatory assessments for employees who violate drug/alcohol policies, designed to determine necessary education or treatment for returning to safety-sensitive duties. While DOT evaluations follow strict federal guidelines, non-DOT evaluations are governed by company policy, though both focus on compliance, rehabilitation, and safe return-to-work.

DOT SAP Evaluations

  • Mandatory For: Employees in safety-sensitive positions (e.g., CDL drivers, aviation, pipeline) who fail or refuse a DOT-mandated test.
  • Process: Requires a face-to-face (or approved remote) assessment with a DOT-qualified SAP. The SAP determines a treatment/education plan, monitors compliance, and conducts a follow-up evaluation.
  • Return-to-Duty: A negative return-to-duty test is required, followed by a specific, long-term follow-up testing plan.
  • Clearinghouse: Results and compliance status are reported to the FMCSA Clearinghouse, which can cause a CDL downgrade if not completed.

Non-DOT SAP Evaluations

  • Mandatory For: Employees in non-federally regulated industries (e.g., construction, manufacturing) with internal drug-free workplace policies.
  • Process: Similar to DOT, a qualified counselor evaluates the employee and recommends treatment, but is guided by company policy rather than federal regulations.
  • Return-to-Duty: Determined by company policy; follow-up testing is not federally mandated but often required by the employer.
  • Purpose: Protects the employer from liability and helps the employee return to work securely, often mirroring the "gold standard" of the DOT process.
